Performance Agreement

THIS PERFORMANCE AGREEMENT (the “Contract”), dated as of _______________, is by and between Jesse Dameron (the “Supplier”) and _______________ (the “Purchaser”), also individually referred to as the “Party” and collectively the “Parties.”

4. Scope of Work

One hour of stage entertainment, with a variation up to 10 minutes, will be provided. Customization is not included. If the Purchaser needs customization, the Purchaser can inquire at info@mentalistjesse.com or 267-261-9930 to see if customization is possible and (if it is) request a quote for the customization fee.

5. Payment Terms

A retainer of _____  USD is required to schedule entertainment. The remaining balance of _____ USD must be received before the time that the entertainment is scheduled for. If the Purchaser cancels the entertainment for any reason, the full fee is still due before the date and time that the entertainment was scheduled for. If Supplier misses the event due to an Act of God, the Purchaser will be reimbursed in full. The total fee is _____ USD. (Customization is not included for this fee.)

6. No Eating During Show

Entertainment is not offered while anyone is eating.

7. No Sounds During Show

Entertainment is not offered while music or other amplified audio is playing. The Purchaser is responsible to ensure the venue does not play amplified audio.

8. Recording Policy

The Purchaser and audience members are not permitted to record any video or audio, but photographs are permitted. The Purchaser grants the Supplier the right to record the event, and use obtained content for promotional purposes.

9. Associates of Performer

The Supplier may arrive at the venue or entertainment show with up to four other individuals.

10. Non-Disclosure Agreement

Unless required to do so by law, both Parties agree never to disclose the existence, facts, terms, or amount of this Contract, nor the substance of the negotiations leading to this Agreement, to any person or entity, other than to their professional counsel or attorney, accountants, or tax preparer; any such disclosure to such persons to be made only if the relevant person must have such information for the implementation of his or her responsibilities. To the extent required by law or applicable regulation, Parties may also disclose the provisions of this Agreement to the appropriate taxing authorities.

11. Designated Announcer and Introduction

The Purchaser will designate an individual to announce the entertainment with the “Show Introduction” provided in the next paragraph.

The following mentalist has been featured on Fox News and performed at the global headquarters of Johnson & Johnson, Majestic Theater, and Delaware Park Casino. Before we begin, please turn off all cell phones and devices capable of recording. Thank you, and please join me in welcoming Jesse Dameron!
